Diggy the smiling dog to stay in Waterford Twp.

Diggy, the adopted dog whose smile and plight made headlines, has plenty of reason to grin these days.

Though he once faced removal from his new Waterford Township home after an investigation over allegations that the dog violated a longstanding local ordinance against pit bulls in the township, the rescue group that placed him there believe the battle is over.

The township on Tuesday dropped all charges against Dan Tillery, Diggy’s new owner, according to Detroit Dog Rescue. That means the pooch stays put.

“We can’t thank Dan, Megan, their legal team, as well as city officials, and all of Diggy’s supporters (enough) for helping to make this happen,” the nonprofit said in a statement on their Facebook page.

Diggy raced into the national spotlight in June, when a photo Tillery snapped with the beaming dog went viral.

Although DDR has said veterinary records prove Diggy is an American bulldog, some believed the pooch appeared to be at least part pit bull, which a 1990 township law forbids. Complaints that Tillery violated the ordinance led police to cite him.

That prompted a petition supporting Diggy and other breeds. During a township board meeting that drew hundreds of fans, Police Chief Scott Underwood said Tillery could keep the pup for 10 days as a court decided his fate.

The dog remained in his care last month, when township officials voted to update its ordinance, letting owners challenge identifications, among other tweaks.

“I’m overjoyed to know that Diggy will be spending the rest of his life where he belongs — with his family,” said Detroit Dog Rescue director Kristina Rinaldi in a statement Tuesday.

“I can’t thank Dan and Megan enough for loving him as much as we do at DDR. I think the whole world loves Diggy! We, at DDR, are thrilled that we were able to help him find his way to a happy forever. Diggy’s road to forever was a combination of so many great people working together and that’s what rescuing dogs is all about.”
